Terms

Wholesaler will have the option of picking up the order from myGemma's New York office or providing an insured shipping label. myGemma's responsibility for the items will pass to Customer upon collection of the invoice by Customer or Customer's shipping company.

All payments are due and discounts are to be taken prior to pick up / shipping. Any payment terms offered are through myGemma's wholesale credit partner, Credit Key. All enquiries regarding payment terms should be made directly to Credit Key at support@creditkey.com

Return Policy

The merchandise is sold as is. All sales are final with no return or exchange privilege. In the event that prior authorization to return was agreed specifically with myGemma, a Return Authorization ("RA") number must be received from myGemma management prior to returning merchandise to myGemma. RA number must be clearly exhibited on the outside of package. Products being shipped back to myGemma for any reason must be properly packaged and fully insured. Customer is responsible for damages or losses incurred in the shipping of products by the Customer to myGemma. Unauthorized returns or returns initiated for collection or other purposes may be returned to Customer or be subject to a 25% restocking charge, at myGemma's sole discretion.

Warranty

myGemma warrants all of its watches to be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. This warranty covers the mechanics and movement of watches. This warranty does not cover accidents, theft, loss, mistreatment, improper use, physical abuse, wear and tear from normal use, or damage resulting from tampering with the product, water or moisture exposure, or other physical damage. Damage resulting from or that occurs due to having the item serviced or modified by a third party null and voids this warranty. THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES (INCLUDING ANY ORIGINAL MANUFACTURER WARRANTIES, WHICH ARE HEREBY EXPRESSLY DISCLAIMED), REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, MYGEMMA SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. MYGEMMA IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION OR UNDER ANY OTHER LEGAL THEORY.

There are no warranties from the manufacturer or Seller with respect to other Goods sold herein (e.g. handbags, jewelry, accessories or any other products sold by myGemma), except as referenced above for watches, expressed or implied, other than as contained on this Invoice.

New York Law

Stipulation that Agreement is governed by New York Law, venue of litigation, service of process: It is hereby stipulated by and between buyer and seller that the purchase referred to herein was made in New York City, New York, regardless of the location where the signature of buyer was affixed hereto, and this purchase agreement shall be interpreted and the rights and duties of the parties hereto governed wholly by the internal law of the State of New York.

Miscellaneous

These Terms and Conditions constitute the entire agreement and understanding of Seller and Buyer with respect to myGemma's goods and supersedes all prior agreements and understandings relating to such goods, including any customary and usual business practices that could affect or relate to the subject matter of this Invoice. In any case, acceptance of the Goods by Buyer, with or without such written notice, constitutes Buyer's waiver of any disagreement as to acceptance of any and all terms confirmed herein.

All diamond weights are exact unless referred to as a fraction in which case the weights are established by estimation or information obtained from the seller and in which case are approximate, refer to the following for size ranges appropriate to each carat weight listing: 1/20 carat .04-.06:1/10 carat .07-.11; 1/8 carat .12-.14; 1/6 carat .15-.17; 1/5 carat .18-.22;1/4 carat .23-.28; 1/3 carat .29-.36; 3/8 carat .37 - .44 carat; ½ carat .45-.57; 5/8 carat .58- .68; ¾ carat .69-.82; 7/8 carat .83-.94; 1/1 carat .95-1.19; 1 ¼ carat 1.20-1.44; 1 ½ carat 1.45-1.94; 2/1 carat 1.95-2.89; 3/1 carat 2.90-3.89;4/1 carat 3.90-4.89; 5/1 carat 4.90-5.89; 6/1 carat 5.90-6.89; 7/1 carat 6.90-7.89;8/1 carat 7.90-8.89; 9/1 carat 8.90-9.90 carat; 10/1 carat 9.90-10.89.

The diamonds herein invoiced have been purchased from legitimate sources not involved in funding conflict and in compliance with United Nations Resolutions. Seller hereby guarantees that these diamonds are conflict-free, based on personal knowledge and/or written guarantees provided by the supplier of these diamonds.
